Attorney appears in Klerksdorp court on theft charge linked to deceased client’s estate
A Klerksdorp-based attorney, Barend Philippus Botha (69), of the Botha de Wet and Roodt law firm, appeared in the Klerksdorp Magistrate’s Court on 11 August after his arrest by the Hawks’ Serious Commercial Crime Investigation unit on allegations he stole trust funds belonging to a deceased client.
The Hawks in North West confirmed the arrest and subsequent charge. Lieutenant-Colonel Tinyiko Mathebula, the Hawks spokesperson in the province, said the matter involves funds that were transferred into the law firm’s trust account in June 2016 but were not paid out to the beneficiary.
"Botha was arrested for allegedly stealing his deceased client’s estate. It is alleged that in June 2016, the Botha de Wet and Roodt law firm was appointed to assist with the estate of their deceased client. Over R130000 was reportedly transferred from the deceased’s bank account into the trust account of the law firm. Investigation revealed that Botha did not transfer the money to the beneficiary," said Lieutenant-Colonel Tinyiko Mathebula.
Botha, who is listed as one of the firm’s directors, was granted R5000 bail with the condition that he attends all scheduled court appearances, Mathebula said. The matter was postponed to 30 September 2026 for an appearance before the Specialised Commercial Crime Court sitting in Klerksdorp.
Local implications and legal context
The case highlights concerns about the handling of estate funds by legal practitioners, matters that can leave bereaved families without timely access to assets they are entitled to. For Klerksdorp residents who rely on local attorneys to administer estates, the arrest of a senior practitioner will raise questions about oversight, trust-account controls and recourse when beneficiaries suspect wrongdoing.
- Amount alleged to have been transferred into the firm’s trust account: R130000
- Bail granted: R5000
- Next court date: 30 September 2026 at the Specialised Commercial Crime Court in Klerksdorp
Under South African law, attorneys hold client and fiduciary duties when administering estates and trust accounts. Allegations of diversion of estate funds are handled as serious commercial crimes and are investigated by specialised units such as the Hawks’ Serious Commercial Crime Investigation, which led this arrest.
What residents should know
The Hawks’ statement did not provide further detail on the identity of the beneficiary or the circumstances that led to the 10-year delay between the June 2016 transfer and the recent arrest. The Specialised Commercial Crime Court will hear the matter on the next appearance, where more particulars of the charge sheet and evidence may be disclosed.
Those with concerns about estate administration or trust-account management can seek redress through the Legal Practice Council, report suspected criminal conduct to SAPS or the Hawks, or obtain legal advice on civil remedies. The outcome of this prosecution could inform community expectations about professional accountability in Klerksdorp.
